This agreement is between you and Brainoid Technologies Ltd (“we”, “us”). It covers the Brainoid IO app, your Brainoid account, and the online services the app uses, such as signing in, membership and cloud AI through Brainoid (together, “the service”). You accept it when you tick the box to agree to it, or when you use the service. If you do not accept it, do not use the service.
Who can use the service
You must be 18 or older. If you create an account for an organisation, you confirm that you are allowed to accept this agreement for it, and the organisation is bound by it too.
Your account
- Opening Brainoid IO needs a free Brainoid account. AI that runs on your Mac still runs on your Mac.
- You sign in with Google, GitHub or Apple, as offered on the sign-in page. Keep that sign-in secure: you are responsible for what is done through your account.
- When you create your account, you choose whether it is for you personally or for an organisation. You cannot change this later.
- Tell us at contact@brainoid.co.uk straight away if you think someone else has used your account.
No guarantees
The service is provided “as is” and “as available”. As far as the law allows, we give no guarantee, warranty or condition of any kind, express or implied. We do not promise that the service will work, be free of errors, be secure, keep your data safe, stay available, or be fit for any purpose.
Security
We do not claim that the current version of the service is secure. It may contain security weaknesses, known and unknown. It may be attacked, misused or abused by others, including hackers, and information on your Mac or in your account could be exposed, changed or lost as a result. Decide what you put into it with that in mind.
Your risk
- You use the service at your own risk.
- Back up anything you cannot afford to lose.
- Do not rely on the service for anything critical: not for the only copy of important information, and not for medical, legal, financial or safety decisions.
- Check anything it produces before you rely on it. AI models can be wrong.
- You are responsible for what you ask the app, and any AI agent in it, to do, and for following the law and the terms of any other service you connect to it.
No responsibility for loss
As far as the law allows, we are not responsible for any loss or damage that arises from the service or from using it, whether in contract, negligence or otherwise, including risks that no one intended or foresaw and attacks on the service by others. This includes loss or corruption of data; damage to your computer, its software or other devices; loss of profit, revenue, business, opportunity or goodwill; and any indirect or consequential loss.
If we are found responsible despite this, our total liability to you is limited to the greater of what you paid us in the 12 months before the claim and £100.
Nothing in this agreement excludes or limits liability that the law does not allow to be excluded or limited, such as liability for death or personal injury caused by negligence, or for fraud. Nothing in it affects your legal rights as a consumer.
Using the service fairly
Do not:
- break the law with it, or use it to harm, harass or deceive anyone;
- try to get into parts of the service, or other people's accounts, that are not yours;
- attack, overload or disrupt the service, or test its security without our written permission;
- share your account with anyone, or resell the service.
Your content
What you create with Brainoid IO is yours. It stays on your Mac unless you choose to send it somewhere, for example to a cloud AI model you allow. Our Privacy Agreement says what we hold about you and why.
Cloud AI and other services
Cloud AI models are provided by third parties. When you use one, its provider's own terms also apply. If you buy a membership or cloud AI credit, the price and what it includes are shown before you pay.
The licence
Brainoid IO's licence says who may use it free and who needs a paid licence. We and our licensors keep all rights in the app and the service. Do not copy, change or reverse engineer the app, except as the law or the licences of the software it includes allow.
Changes and ending
We may change, suspend or end the service, or any part of it, at any time. We may suspend or close your account if you break this agreement, or if we have to for legal or security reasons. You may stop using the service at any time, and ask us to delete your account by writing to contact@brainoid.co.uk.
The alpha
While Brainoid IO is in alpha, the Alpha Tester Agreement also applies. Where it differs from this agreement, the Alpha Tester Agreement applies to the alpha.
Other terms
Our Terms and Conditions cover this website. Where they differ from this agreement about the app or your account, this agreement applies.
New versions
We may update this agreement. Each version has the version number shown at the top. When we publish a new version, the app asks you to accept it before you carry on using the service.
Law
This agreement is governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in the courts where you live.
